Skechers Injury Lawsuit
The complaint states that the plaintiff bought Skechers Shape-Ups in January 2011 and wore them regularly while performing her daily activities. Within a month of wearing Shape-Ups, the plaintiff was walking when the rocker-bottom on her shoes allegedly caused her to roll forward, lose her balance and fall down. The next day, the plaintiff sought medical care, as she had been experiencing intense pain in one of her fingers and in one of her knees. After undergoing various diagnostic tests, doctors determined that the plaintiff had broken her index finger and had torn the ACL in one of her knees. Surgery was required to treat the serious Skechers knee injury, which is still a source of pain for the plaintiff.
Skechers Shape-Ups deceptive claims?
Court documents go on to lay out evidence that “the health risks of Skechers outweigh the absence of any benefit provided to [individuals who wear Shape-Ups].” In fact, the complaint alleges that the unstable and defective rocker-bottom design of Skechers Shape-Ups caused the plaintiff's injuries. The complaint also alleges that the Skechers acted negligently by purposely misrepresented the health benefits of these toning shoes [http://www.nbcnews.com/business/skechers-pay-40-million-over-deceptive-ads-775405 and that Skechers was negligent in its failure to conduct safety testing on Shape-Ups even after consumers reported alleged Skechers injuries to the Consumer Product Safety Commission (CPSC). In fact, the CPSC has received more reports of alleged Skechers toning shoe injuries than injury reports for any other product in its database (as of May 2011).
In May 2012, Skechers was ordered to pay the Federal Trade Commission $40 million to settle FTC charges after the courts agreed with such findings of Skechers deceptive claims by ruling that Skechers had overstated the health benefits of Shape-Ups.
