According to the Skechers foot fracture lawsuit, (Case No 3:13-cv-00018-TBR) the plaintiff received the Skechers Shape-Ups toning shoes from her mother in October 2010. In February 2011, while walking on a flat surface, the plaintiff experienced excruciating pain. The plaintiff was diagnosed as having a fractured metatarsal bone in her right foot and a severely sprained right ankle. As a result of these injuries, the plaintiff alleges that she was required to wear a boot cast for nearly five months and incurred significant medical expenses. Furthermore, the plaintiff alleges that she was unable to work and lost wages, and that her ability to earn money has been impaired because of her injuries.
The Skechers foot fracture lawsuit alleges that the health risks of Skechers Shape-Ups toning shoes outweigh the absence of any benefit provided to the wearer because of their rocker-bottom sole. The lawsuit also refers to a Consumer Reports study that found that Skechers has seen more reports of injuries or complaints than any other product in the Consumer Product Safety Commission’s product complaint database. Further, the complaint also alleges that Skechers Shape-Ups footwear, because of the instability and alteration of gait mechanics that the rocker bottom sole creates, places consumers at an increased risk for chronic injuries like stress fractures, ruptured tendons, and injuries from falling.
