Parker Waichman LLP Represents Wisconsin Woman in Lawsuit Alleging Mirena IUD Perforated her Uterus, Causing Serious Pain and Injuries

Parker Waichman LLP, a national law firm dedicated to protecting the rights of victims injured by defective medical devices, has filed a lawsuit alleging that the Mirena IUD perforated a Wisconsin woman’s uterus. The lawsuit was filed on Aug. 13, 2013, in the Superior Court of New Jersey Law Division, Morris County (Case No. L-6579-13). Bayer Healthcare Pharmaceuticals Inc., Bayer Healthcare Ag, Bayer Pharma Ag, and Bayer Oy were named as Defendants.

According to the Complaint, the Plaintiff was implanted with the Mirena IUD in June 2009. At that time, there was no reason to suspect that the IUD had perforated her uterus. The lawsuit points out that Bayer’s warning label only mentions the risk of spontaneous migration happening after the device is first placed in the uterus. On Jan. 31, 2011, the Plaintiff went to her doctor’s office to have an ultrasound, which revealed that the IUD may have become embedded in the wall of her uterus. An MRI confirmed the ultrasound’s findings. On Feb. 22, 2011, she underwent a laparoscopy to remove the IUD. The lawsuit is seeking compensation for severe and permanent physical injuries, substantial pain and suffering, and economic loss due to medical expenses and lost wages. The lawsuit alleges that Bayer knew that the Mirena IUD was defective but failed to warn of the risks.

The lawsuit alleges that Bayer has a history of misrepresenting Mirena. In a warning letter sent to the company by the U.S. Food and Drug Administration (FDA) on Dec. 30, 2009, the Department of Health and Human Services’ Division of Drug Marketing, Advertising, and Communications (DDMAC) criticized the company for making unsubstantiated claims about the device while failing to mention its risks in the company’s “Simple Style” program. The department also criticized the company for a number of statements, including the assertion that Mirena helps women “look and feel great.”

The lawsuit further notes that Bayer’s Mirena IUD was approved in 2000. It is a contraceptive that is supposed to prevent pregnancy for up to five years. The IUD is a small, plastic device that is attached to two strings. Once placed inside the uterus by a healthcare professional, it releases the hormone levonorgestrel.

According to an Oct. 1, 2009, FDA press release, the most serious side effects associated with the Mirena IUD include:

  •     Perforation of the uterine wall
  •     Embedment of the device in the uterine wall
  •     Intrauterine pregnancy
  •     Ectopic pregnancy
  •     Group A streptococcal sepsis
  •     Pelvic inflammatory disease (PID)

Recently, the Supreme Court of New Jersey reconsidered its previous decision and has moved to centralize Mirena IUD lawsuits in Bergen County, where Superior Court Judge Brian R. Martinotti will manage them, according to court documents.
