Carlson Laboratories, and Metagenics, Inc. announced today that they have agreed to dismiss the patent infringement suit entitled Nordic Naturals, Inc. v. J.R. Carlson Laboratories, Inc., and Metagenics, Inc., filed by Nordic Naturals on May 2, 2007 in the U.S. District Court for the Northern District of California. Under the terms of the stipulated dismissal, Nordic Naturals' claims for patent infringement and unfair competition under the Lanham Act were dismissed with prejudice. Carlson Laboratories' and Metagenics' declaratory relief claims for non-infringement were dismissed with prejudice, and their affirmative defenses and declaratory relief claims for invalidity were dismissed without prejudice.
