New York Woman Suffers Injuries Allegedly Due to Boston Scientific’s Transvaginal Mesh Device, Lawsuit Filed by Parker Waichman LLP

Parker Waichman LLP, a national law firm dedicated to protecting the rights of victims injured by defective medical devices, has filed a lawsuit on behalf of a New York woman who alleges that she was injured by a transvaginal mesh device.

The suit was filed on April 30, 2013, in the U.S. District Court for the Southern District of West Virginia, Charleston Division (Case No. 2:13-cv-09644), where it is one of many cases pending in the multidistrict litigation entitled In Re: Boston Scientific Corp. Pelvic Repair System Products Liability Litigation, MDL No. 2326. Boston Scientific Corporation is named as the Defendant.

According to the Complaint, the Plaintiff was implanted with the PolyForm Synthetic Mesh in April 2010. The lawsuit alleges that this device is defective and caused a number of serious injuries. Furthermore, the suit alleges that the Defendant knew about these risks and failed to warn the Plaintiff, her doctor or other consumers. She is suing for negligence on three counts of strict liability (design defect, manufacturing defect and failure to warn), breach of express and implied warranty, loss of consortium (for her husband), fraudulent concealment and punitive damages.

A Joint Status Conference is scheduled for May 23rd regarding the thousands of transvaginal mesh lawsuits pending in U.S. District Court for the Southern District of West Virginia. The lawsuits have been formulated into five MDLs, which are entitled: In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation, MDL No. 2325; In Re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation, MDL No. 2326; In Re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation, MDL No.
