New Jersey Court Consolidates Statewide Mirena IUD Lawsuits, Rottenstein Law Group LLP Reports

On May 24 the New Jersey Supreme Court agreed to consolidate state Mirena IUD lawsuits into a multicounty litigation matter, according to court documents. More than 60 Mirena hormonal IUD cases were consolidated onto the docket of Judge Brian R. Martinotti, according to court records in In RE Mirena Litigation (Case No. 297, Superior Court of New Jersey, Bergen County).*

“A multicounty litigation, like a federal multidistrict litigation, is a way to reduce duplicative processes, thereby saving time, effort, and money during pretrial proceedings,” said Rochelle Rottenstein, principal of the Rottenstein Law Group. “This is better for all parties involved because it makes eligible cases more likely to get to trial quickly, after which each plaintiff could receive his or her own damages award.”

In addition to the New Jersey MCL, more than 50 lawsuits are included in the federal multidistrict litigation (In re: Mirena IUD Products Liability Litigation; MDL No. 2434, U.S. District Court for the Southern District of New York). The plaintiffs allege that their Mirena hormonal IUD implants have caused them many side effects, including uterine perforation, device migration and pelvic pain, according to court documents.
