Chicago, IL (PRWEB) January 29, 2009 -- L. Timothy Terry, formerly president of the National Association of Medicaid Fraud Control Units and Director of Nevada's Medicaid Fraud Control Unit, has joined the Whistleblower Action Network through his law firm, The Terry Law Firm, Ltd. of Carson City, Nevada.

The Whistleblower Action Network is a team of attorneys dedicated to representing citizens, known as "relators," who witness fraud against the government. These citizen relators are empowered to bring cases for the government by "qui tam" provisions of federal and state False Claims Acts, which protect and encourage whistleblowers to assist taxpayers recover from frauds against the government. Further information about the Whistleblower Action Network and qui tam suits can be found at www.WhistleblowerAction.com.

In recent years, the Whistleblower Action Network has achieved remarkable successes for their relator clients and taxpayers through qui tam actions. These include a $400 million Medicaid fraud settlement with Merck Inc. involving the drugs Vioxx® and Zocor® (EDPA 00CV6158); a $134 million defense contracting fraud settlement with Northrop Grumman Corp. involving the B-2 "Stealth" Bomber (NDIL 89C6911); a $50 million Medicaid fraud settlement with Omnicare, the nation's largest pharmacy for nursing homes (NDIL 01C7433); a $37 million Medicaid fraud settlement with CVS Caremark Corp. involving generic Zantac® (NDIL 03C742); a $35 million Medicaid fraud settlement with Walgreens Co. involving generic Prozac® (NDIL 03C744); and a $15 million defense procurement fraud settlement with ad agency Leo Burnett involving minority subcontracting (NDIL 04C3897.

Further information about these settlements can be found at www.DrugFraudSettlement.com and www.PharmacyFraudSettlement.com.

As a former state prosecutor in Nevada Attorney General's Office, Terry highlighted the increasing role of state False Claims Acts in successfully prosecuting national Medicaid fraud schemes by pharmacies, pharmaceutical manufacturers, hospitals and other health care providers. "The states have dynamically increased their pursuit of qui tam fraud recoveries, by using the expertise of whistleblowers and their attorneys," said Terry. "The Whistleblower Action Network has been at the forefront of relator's lawyers in this area, and I'm thrilled to be able to work with them."

Whistleblower Action Network lawyers have dedicated their law practices to representing citizens-whistleblowers willing to help state and federal government efforts to fight fraud. Whistleblower Action attorneys include Steven H. Cohen of the Cohen Law Group in Chicago, Illinois, Michael I. Behn and Linda Wyetzner of Behn & Wyetzner, Chartered in Chicago, Illinois, and BethAnne Yeager of the Law Offices of BethAnne Yeager in Madison, Wisconsin. Cohen, Behn, and Yeager are among the very few to have been recognized as Whistleblower's "Lawyers of the Year" by their colleagues, through the national False Claims Act organization Taxpayers Against Fraud.

Steve Cohen welcomed Terry's contribution to the team. "Tim joins us after nearly 20 years of distinguished public service, with an amazing reputation for successfully negotiating difficult national Medicaid fraud qui tam settlements, involving numerous states, federal agencies, and relators," said Cohen. "Tim's spearheaded Medicaid fraud settlements against some of the largest health care companies in America, including Abbott, Bayer, ColumbiaHCA, Dey, Longs Drug Stores, SmithKlineBeecham, and Tenet."

Michael Behn highlighted Terry's leadership role in the National Association of Medicaid Fraud Control Units, known as "NAMFCU." "The National Association of Medicaid Fraud Units forms our nation's front line defense against Medicaid fraud," said Behn. "Tim's comfortable both in the trenches and at the helm, having handled over 100 False Claims Act cases and having led NAMFCU as its President and on its Executive Committee."

Terry received national attention last year, for achieving the $650 settlement of qui tam cases against the pharmaceutical giant, Merck. Terry led the joint federal-state team in an eight-year Medicaid fraud investigation. As lead counsel for the State of Nevada in Nevada ex rel. Steinke v. Merck, Tim obtained a landmark decision establishing False Claims Act liability for pharmaceutical companies who fail to comply with their Best Price reporting obligations required by the federal Medicaid Rebate Act. "Tim showed that he could beat Merck in court," said Behn "Without his skill and stamina, there's no way the state and federal Medicaid programs could have achieved that amazing success."

Terry's legal career started in 1978 as a Law Clerk to Justice Gordon Thompson of the Nevada Supreme Court. He served two additional years at the Court as Deputy Supervising Staff Attorney. Before his appointment as Director of Nevada's Medicaid Fraud Control Unit in 1991, he was engaged in the private practice of law in Carson City.

"We're pleased that whistleblowers will be able to benefit from Tim's expertise and sound counsel," concluded Cohen. "In a tough situation, you couldn't ask for a better lawyer by your side."
