Nationally Recognized Medicaid Fraud Prosecutor Tim Terry Joins Successful Whistleblower Law Practice, Specializing in "Qui Tam" Citizen Suits Under False Claims Acts

L. Timothy Terry, formerly president of the National Association of Medicaid Fraud Control Units and Director of Nevada's Medicaid Fraud Control Unit, has joined the Whistleblower Action Network through his law firm, The Terry Law Firm, Ltd. of Carson City, Nevada. As a former state prosecutor in Nevada Attorney General's Office, Terry highlighted the increasing role of state False Claims Acts in successfully prosecuting national Medicaid fraud schemes by pharmacies, pharmaceutical manufacturers, hospitals and other health care providers. "The states have dynamically increased their pursuit of qui tam fraud recoveries, by using the expertise of whistleblowers and their attorneys," said Terry. "The Whistleblower Action Network has been at the forefront of relator's lawyers in this area, and I'm thrilled to be able to work with them."

Whistleblower Action Network lawyers have dedicated their law practices to representing citizens-whistleblowers willing to help state and federal government efforts to fight fraud. Michael Behn highlighted Terry's leadership role in the National Association of Medicaid Fraud Control Units, known as "NAMFCU." "The National Association of Medicaid Fraud Units forms our nation's front line defense against Medicaid fraud," said Behn. "Tim's comfortable both in the trenches and at the helm, having handled over 100 False Claims Act cases and having led NAMFCU as its President and on its Executive Committee."
   
Terry received national attention last year, for achieving the $650 settlement of qui tam cases against the pharmaceutical giant, Merck. Terry led the joint federal-state team in an eight-year Medicaid fraud investigation. As lead counsel for the State of Nevada in Nevada ex rel. Steinke v. Merck, Tim obtained a landmark decision establishing False Claims Act liability for pharmaceutical companies who fail to comply with their Best Price reporting obligations required by the federal Medicaid Rebate Act. "Tim showed that he could beat Merck in court," said Behn "Without his skill and stamina, there's no way the state and federal Medicaid programs could have achieved that amazing success."

Terry's legal career started in 1978 as a Law Clerk to Justice Gordon Thompson of the Nevada Supreme Court. He served two additional years at the Court as Deputy Supervising Staff Attorney. Before his appointment as Director of Nevada's Medicaid Fraud Control Unit in 1991, he was engaged in the private practice of law in Carson City.
