Multiple Imprelis Lawsuits Filed by Wright & Schulte Alleging Imprelis Use Resulted in Extensive Tree Damage and Death
Date:4/20/2013

Columbus, OH (PRWEB) April 20, 2013

The attorneys at Wright & Schulte, LLC have filed multiple Imprelis lawsuits on behalf of various plaintiffs throughout the U.S. The plaintiffs in these cases, which were filed in late March through early April, are individual property owners, lawn care and landscape companies and one country club. All of these Imprelis cases allege that use of Imprelis herbicide resulted in the plaintiffs’ trees, shrubs and other plant life being irreversibly damaged. These Imprelis lawsuits also allege that DuPont mislead consumers in Imprelis advertising and that, even after consumers reported Imprelis damage, DuPont failed to acknowledge the dangers associated with its herbicide. The defendant in all of these Imprelis tree damage lawsuits has been named as E.I. DuPont De Nemours and Co.

Wright & Schulte, LLC specializes in defending the rights of those who have suffered damages and losses after the use of dangerous products. The Imprelis tree damage lawsuits that Wright & Schulte have recently filed specifically include an Imprelis lawsuit filed on March 21, 2013 on behalf of 17 property owners in Ohio, New Jersey, Indiana, North Carolina and Michigan (Case No. N13C-03-242 JRJ); an Imprelis lawsuit filed on April 3, 2013 on behalf of 28 property owners in Ohio, Iowa, Indiana, Missouri and Pennsylvania (Case No. N13C-04-039 EMD); an Imprelis lawsuit filed on April 4, 2013 on behalf of Bloomington Country Club in Indiana (Case No. N13C-04-044 EMD); and an Imprelis lawsuit filed on April 4, 2013 on behalf of 18 lawn care and landscaping companies in Ohio, New Jersey, Wisconsin, Iowa and Minnesota (Case No. N13C-04-045 EMD).

Alleged Imprelis Tree Damage
Court documents associated with all four cases point out that DuPont initially marketed Imprelis as having significant advantages over other herbicides on the market and that this herbicide was the “most advanced turf herbicide in over 40 years.” However, as mentioned in businessweek.com, lawn care professionals have described Imprelis, which is four times more powerful than Agent Orange, as the industry’s “Hurricane Katrina.” Many industry professionals also allege that the full extent of the damage DuPont’s Imprelis has caused is only just beginning to manifest itself. The Imprelis lawsuits also allege that even after consumers began to report Imprelis tree damage to DuPont, the company denied that Imprelis herbicide was dangerous and tried to attribute the tree death to other factors, such as improper application of the herbicide.

EPA Orders DuPont to Stop Selling Imprelis
As nationwide consumer reports of Imprelis tree damage piled up, in June 2011, the EPA initiated its own investigation into the alleged problems with Imprelis. By August 2011, the EPA had uncovered sufficient evidence that Imprelis was responsible for seriously damaging or killing thousands of trees and, as a result, ordered DuPont to immediately stop selling and distributing Imprelis herbicide. At that time, the EPA has received more than 7,000 reports of Imprelis tree damage from consumers nationwide. (http://www.epa.gov/compliance/resources/cases/civil/fifra/dupontimprelis.html)
