According to court records, at least 159 Mirena IUD lawsuits are now pending in the federal multidistrict litigation underway in the U.S. District Court, Southern District of New York. The Court is scheduled to convene the Mirena litigation’s next Status Conference on Tuesday, September 24th, at 9:30 a.m. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)

Mirena IUD Lawsuits
All of the Mirena lawsuits pending in the Southern District of New York allege that users of the IUD suffered uterine perforations, uterine embedment, ectopic pregnancy, and other serious Mirena complications after the IUD migrated from its position in the uterus after having been properly inserted by a healthcare provider. All of the claims accuse Bayer Healthcare Pharmaceuticals of failing to provide adequate warnings regarding the possibility of spontaneous migration, and of exaggerating Mirena’s benefits while downplaying its risks.
In addition to the claims pending in New York, court records indicate that 215 Mirena IUD lawsuits involving similar allegations are also pending in a multicounty litigation underway in New Jersey’s Bergen County Superior Court. The Mirena IUD has been available for sale in the U.S. since 2000, has been approved by the Food & Drug Administration (FDA) as a long-acting contraceptive, and as a treatment for heavy menstrual bleeding in women who wish to use an IUD as their primary method of birth control. In 2009, Bayer received an FDA Warning Letter which took the company to task over marketing claims the agency deemed to be misleading. Recent media reports indicate that the FDA has received more than 70,000 complaints involving Mirena complications, including instances of device dislocation and uterine perforation, since the IUD was first brought to market.*
