Mirena IUD Lawsuits Update: Ohio Woman Alleges Her IUD Punctured Her Cervix, Rottenstein Law Group LLP Reports

More women are seeking compensation for injuries they allegedly suffered as a result of the implantation of their Mirena hormonal birth control device. The Rottenstein Law Group LLP, which operates a page dedicated to providing information about Mirena IUD lawsuits and side effects, notes that most recently on July 12 an Ohio woman filed a lawsuit in federal court in Pennsylvania.

Plaintiff Lourdes Gonzalez filed the complaint in the U.S. District Court for the Eastern District of Pennsylvania, alleging that Mirena IUD maker Bayer Pharmaceuticals knew the risks associated with the intrauterine device but marketed it anyway and that the device had migrated and punctured her cervix two years after her 2009 device implantation. Gonzalez seeks at least $150,000 in damages, according to court documents in Gonzalez v. Bayer Pharmaceuticals Corporation et al. (2:13-cv-04082-JP, U.S. District Court for the Eastern District of Pennsylvania).

“In total, there are more than 100 federal Mirena lawsuits currently pending,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP, referring to cases consolidated in federal court, under the caption IN RE: Mirena IUD Products Liability Litigation (MDL-2434; U.S. District Court for the Southern District of New York). “These plaintiffs and their doctors trusted that the Mirena birth control device would not harm them. If the allegations in the complaint are true, then Bayer needs to be held accountable for its actions.”

As of June 2013, the U.S Food and Drug Administration received more than 70,000 adverse event reports regarding the Mirena since the IUD’s 2000 debut, according to NBC 5.* The complaints centered on a few potential side effects, including device migration and uterine perforation, both of which could involve the IUD becoming embedded elsewhere.
