Mesh Lawsuit News: Bernstein Liebhard LLP Notes New Order in Federal Ethicon Vaginal Mesh Lawsuits

Bernstein Liebhard LLP’s Mesh Lawsuit Center reports that claims alleging injuries from Ethicon Inc. mesh products continue to move forward in the federal multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia. According to a Pretrial Order issued on July 26, 2013, the Court has granted Plaintiffs’ Motion to compel responses to certain discovery requests. Ethicon Mesh Lawsuits
Court documents indicate that more than 8,460 Ethicon mesh lawsuits are currently pending in the litigation underway in West Virginia. The Ethicon litigation is just one of several that have been established in that district for vaginal mesh lawsuits. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is also serving on the Plaintiffs Steering Committees for: In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); and In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”).

Johnson & Johnson and its Ethicon unit are also named defendants in more than 4,360 mesh lawsuits pending in a multicounty litigation underway in New Jersey’s Atlantic County Superior Court. C.R. Bard faces just over 800 claims filed in a second consolidated proceeding pending before the same judge. Mr. Grand has been named Co-Liaison Counsel in both litigations, and was a member of the trial team for the first Ethicon trial that concluded in March with an $11 million verdict for the plaintiff. Mesh lawsuits have been mounting since October 2008, when the U.S. Food and Drug Administration (FDA) alerted the public that it had received more than 1,000 reports of serious vaginal mesh complications. In July 2011, the FDA issued a second alert, warning that the frequency of complications associated with transvaginal prolapse repair was “not rare.” While none of the manufacturers named in the ongoing litigation has issued a mesh recall in response to the FDA warning, Ethicon did announce in June 2012 that it would stop sales of some of its Gynecare devices due to commercial concerns.
