Los Angeles Personal Injury Attorney Jeff Nadrich Responds to News that Johnson & Johnson Inadequately Assessed Metal Hip Dangers

New testimony from the ongoing DePuy ASR hip lawsuit* against Johnson & Johnson reveals that J&J may have severely underestimated the potential for failure in its Articular Surface Replacement, or A.S.R. implant, according to a new article from the New York Times. As the article outlines, a J&J internal review—conducted after the 2010 recall of the ASR—found that the company’s orthopedic unit “had used inadequate or incorrect standards in trying to assess some of those risks before first selling the implant in 2003.”

The report was introduced last week in Los Angeles Superior Court, in the first DePuy lawsuit to go to trial. More than 10,000 similar lawsuits have also been filed in the United States, all of them stemming from side effects and complications related to the ASR and other DePuy hip devices. The Times further points out that one of the company’s compliance managers—Jimmy Smith—was asked about the report, and confessed that company officials had not used appropriate engineering controls to try to anticipate the A.S.R’s potential problems. “They did their job, but they could have done it better,” Mr. Smith said.

The Times article further outlines that in a separate testimony, DePuy engineer Graham Isaac testified that before selling the A.S.R., the company only tested its performance on laboratory equipment at one angle of implantation. Orthopedic surgeons, however, can implant the artificial hip from a variety of angles.
