$96 Million Jury Verdict Secured by Business Law Firm That Took on Medical
Malpractice Case for a Child of Firm's Partner
LOS ANGELES, Jan. 31 /PRNewswire/ -- Richardson & Patel, LLP, a business law firm with offices in Los Angeles and New York City announced today that the Los Angeles Daily Journal newspaper named the firm's $96 million judgment against Verdugo Hills Hospital as the largest jury verdict in the State of California for 2007.
Notable on several levels, this verdict was the first medical malpractice case for the firm, which specializes in corporate and securities law. Moreover, the plaintiff, four-year-old Aidan Leung, is the son of partner Kevin Leung, head of the firm's Asia Practice Group.
The case was tried by Luan K. Phan, Richardson & Patel's Managing Partner of Litigation and a Loyola Law School classmate of Mr. Leung. Mr. Phan found himself going head-to-head against top med mal trial firms and walking away with a decisive victory.
Though their work tends toward securities and corporate law matters, Mr. Leung's fellow partners agreed to champion Aidan's case after he suffered severe brain damage from kernicterus, a preventable neurological disorder caused by severe jaundice. The hospital failed to diagnose, warn, or treat Aidan properly and its negligence proved devastating. Aidan cannot walk, talk, sit or stand. He has normal intelligence, but is a prisoner trapped in a body that does not work.
After years of contentious litigation, and six weeks of trial, on July 2, a jury from the conservative Glendale courthouse awarded Aidan over $96 million in future damages, with a present value of $15 million.
