Johnson Comments on the Arrest of Happy Gilmore Villain

Best known for his roll in Happy Gilmore, actor Christopher McDonald was pulled over last week and charged with drunk driving. DUI attorney Dane Johnson says that the charges may not be as serious as they sound.

The arrest came early Wednesday morning when McDonald was pulled over by state troopers according to KHOU News (10.16.2013). There was no crash and no one was hurt.

McDonald played as “Shooter” McGavin, the villain of the 1996 Adam Sandler comedy. In it, he tried to drive aspiring golf star “Happy” Gilmore (Sandler) out of the sport, resorting to cheating and even violence. Johnson says that his alleged real-life lawbreaking is far less extreme.

“DUI laws are stricter than most people think,” said Johnson, the founder of Johnson, Johnson & Baer law firm, who works extensively on drunk driving cases. “The result is that normal, everyday people get pulled over.”

According to KHOU, the trooper who arrested McDonald said that he began to suspect the actor had been drinking only after pulling him over. He asked McDonald to perform a breathalyzer test and the result was a 0.15% blood alcohol content. The legal limit in all states is 0.08%.

Johnson says breaking the legal limit is deceptively easy.

“0.08% is what you hit after having one, or at most two drinks,” Johnson said. “Most people feel safe to drive after having a single drink.”

Blood alcohol content can also remain elevated long after drinking, Johnson says.

“If you have wine with dinner, and then hours later you drive to the store, chances are you are over the legal limit,” he said.

McDonald was put in jail with a $1,000 bond reported KHOU.
