Increase to Almost 40,000 Transvaginal Mesh Lawsuits in Federal Court Leads to Expanded Leadership Committee, Notes Rottenstein Law Group LLP

There are now almost 40,000 transvaginal mesh injury lawsuits pending in a consolidation in federal court in West Virginia, a size that has necessitated the expansion of the plaintiffs’ executive committee, according to court documents. The vaginal mesh firm Rottenstein Law Group LLP, which maintains the informational website http://www.vaginalmeshlawsuitscenter.com, comments on the news and offers its insight.

Judge Joseph R. Goodwin in a Dec. 6 order added three attorneys to the committee, which is in charge of the plaintiffs’ side of six different multidistrict litigation matters (consolidations) that are now made up of almost 40,000 pending lawsuits, according to court documents (In re: C.R. Bard, Inc., Pelvic Repair System Products Liability Litigation; MDL-2187, U.S. District Court for the Southern District of West Virginia).

“That there are so many pending transvaginal mesh lawsuits, and that the number increases steadily each month, is not particularly surprising, even if it is alarming,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “And along with an increase in number of cases is an increase in the work required to ensure successful pretrial proceedings. That is why enlarging the plaintiffs’ executive committee makes sense. The size of the litigation requires a greater number of people leading the plaintiffs to the pretrial milestones.”

Settlements and Verdicts
There have already been a handful of bellwether trials in at least one of the MDLs. Of the three previous C.R. Bard mesh injury bellwether lawsuits, two had outcomes in which the plaintiff received some kind of compensation. In the first, on Aug. 15, 2013, a jury awarded plaintiff Donna Cisson about $2 million in damages, according to court documents (Cisson v. C. R. Bard, Inc., 2:11-cv-00195; U.S. District Court for the Southern District of West Virginia). In the second trial, which occurred a week later, plaintiff Wanda Queen settled out of court for an undisclosed sum, according to court documents (Queen et al v. C. R. Bard, Inc., 2:11-cv-00012; U.S. District Court for the Southern District of West Virginia).

There are also five MDL defendants considering vaginal mesh settlements. C.R. Bard, AMS, Coloplast, Cook Medical and Boston Scientific were reportedly in talks to settle tens of thousands of vaginal mesh injury lawsuits, according to a Sept. 30 Bloomberg article.*
