Boston, MA (PRWEB) June 13, 2013
Gilman Law LLP, a leading consumer protection plaintiffs’ law firm, reports that an Imprelis class action lawsuit settlement has been reached in the U.S. District Court, Eastern District of Pennsylvania, on behalf of property owners who sustained damage to trees on their property, allegedly due to DuPont’s Imprelis herbicide. Gilman Law filed a lawsuit on behalf of a property owner on August 1, 2012 (Case No. 2:12-cv-04343-GP, E.D.PA). The Imprelis lawsuit provides compensation for: property owners, lawn care professionals, and golf courses and other self-applicators. Persons and entities who wish to participate in the Imprelis class action must submit a claim form to the Court no later than June 28, 2013.
Gilman Law LLP is warning all property owners affected by Imprelis that they have only a few days left to opt out of the Imprelis settlement if they feel its terms are inadequate and pursue an individual claim to maximize the recovery of compensation to which they are entitled. By opting out, they will maintain their right to file an individual Imprelis claim against DuPont to obtain compensation for their dead and dying trees and to seek full compensation and remediation. Failure to inform the Court, in writing, of their desire to opt out of the Imprelis class action lawsuit by the June 28th deadline or to file the necessary claim form paperwork will bind them to all of the Court’s Orders, and will forever bar them from filing an individual Imprelis tree damage claim, regardless of whether they sustain damage in the future.
Property owners who have not yet filed a claim form in the Imprelis lawsuit settlement, as well as those considering opting out of the class action settlement, are urged to call Gilman Law LLP today for a free legal evaluation of their case. The firm’s Imprelis lawyers are available to review your potential claim and advise you on the best way to proceed. However, property owners must contact Gilman Law LLP immediately and file the appropriate paperwork before the Court imposed June 28th deadline to ensure they preserve their right to compensation. About Imprelis Lawsuits
Imprelis herbicide was introduced by DuPont in 2010, and marketed as a more environmentally friendly herbicide than other weed killers. However, the U.S. Environmental Protection Agency (EPA) began investigating Imprelis tree damage and death reports in June 2011, after receiving complaints from Maine, Massachusetts, New Hampshire, Connecticut, as well as all states in the United States, except California and New York. In early August 2011, DuPont announced it would issue an Imprelis recall and stop sales of the herbicide. The EPA issued a Stop Sale and Removal Order (SSRO) for Imprelis on August 11, 2011.
