Much has been written about this election regarding the rights of the unborn. The rights of a fetus have been debated in courthouses throughout the country. Many states, such as New Jersey, New York, North Carolina and Wisconsin have ruled that a child can bring an independent cause of action against his or her mother's obstetrician upon reaching the age of majority if there was negligence that caused injury at child birth.

Nationally renown personal injury attorney Robert Clifford of Chicago wrote about the issue involving a baby who was born in a breech position and with a torn umbilical cord. Little Patrick Draper suffered permanent injury and as a 20-year-old adult, he brought a lawsuit.
