Federal DuPont C8 Lawsuits Transferred to U.S. District Court, Southern District of Ohio, Alonso Krangle LLP Reports

Alonso Krangle LLP, an experienced personal injury law firm, reports that DuPont C8 lawsuits stemming from pollution at DuPont’s Washington Works plant in Parkersburg, West Virginia, have been consolidated in a multidistrict litigation and transferred to the U.S. District Court, Southern District of Ohio. According to a Transfer Order issued by the U.S. Judicial Panel on Multidistrict Litigation (JPML) on April 8th, the DuPont C8 lawsuit litigation currently consists of 26 actions, all of which were originally filed in federal courts in Ohio or West Virginia. The Honorable Edmund A. Sargus, Jr. was tapped by the Panel to oversee the multidistrict litigation. (In Re: E.I. Du Pont De Nemours and Company C-8 Personal Injury Llitigation, MDL No. 2433.)

According to the Panel’s Transfer Order, all of the DuPont C8 lawsuits allege wrongful death or personal injury resulting from exposure to drinking water contaminated with C8. C8, also known as perfluorooctoanoic acid (PFOA), is a chemical used in the manufacture of Teflon that was discharged from the DuPont Washington Works Plant in Parkersburg for decades. All of the plaintiffs who have filed DuPont C8 lawsuits claim they developed diseases that were identified as potentially linked to C-8 exposure by a study conducted as part of a 2005 class action settlement between DuPont and 80,000 people living in six Ohio and West Virginia water districts that were allegedly contaminated with the chemical when it was discharged from the Washington Works facility, the Transfer Order said.

According to a report published May 1st in the Gallipolis Daily Tribune, C8 was detected in the six water districts in 2001 and 2002. As part of the 2005 DuPont C8 class action lawsuit settlement, personal injury lawsuits and wrongful death claims filed at that time were put on hold until the C8 Science Panel determined the health effects associated with the chemical. (Leach v. E.I. Du Pont De Nemours & Co., No. 01-C-608 (W. Va. Cir. Ct.) In October 2012, the C8 Science Panel determined that exposure to the chemical is linked to pre-eclampsia, high cholesterol, thyroid disease, ulcerative colitis, and kidney and testicular cancer. The water districts found to have been contaminated include: Belpre, Tuppers Plains, Little Hocking and Pomeroy in Ohio and Lubeck and Mason County in West Virginia, according to the Daily Tribune.
