A status conference to discuss matters related to federally-filed Biomet hip lawsuit (http://www.consumerinjurylawyers.com/biomet-magnum-hip-replacement) claims is scheduled to take place next month in a federal litigation now housing more than 700 cases, Bernstein Liebhard LLP reports.
A Case Management Order issued in September indicates that an upcoming conference in the federal Biomet hip replacement proceeding established in the U.S. District Court, Northern District of Indiana will be held telephonically on November 18th at 9:00 a.m. This meeting will involve claims over the Biomet M2a Magnum metal-on-metal hip replacement, which has been associated with early failure rates and the need for revision surgery in recipients who have come forward to file Biomet lawsuits. According to a recent Case List update from the U.S. Judicial Panel on Multidistrict Litigation (JPML) a total of 725 Biomet hip lawsuits were pending in the Northern District of Indiana as of October 17th, 2013. These cases similarly allege that Biomet Inc. failed to properly warn patients and their doctors about the potential for early failure complications to stem from use of its product. Given the design of this implant, which consists of a chromium-cobalt femoral head and acetabular shell, dangerous amounts of metal debris may shed into the blood stream.
Metal hip replacement implants like the Biomet M2a Magnum have increasingly become a subject of concern by the U.S. Food and Drug Administration (FDA). In January 2013, the federal agency proposed new regulations regarding metal-on-metal hip devices that would require all devices to undergo rigorous testing prior to receiving market approval. In its alert, the FDA advised all metal hip recipients to undergo blood testing if they are experiencing symptoms that may indicate premature device failure.
