Ethicon Vaginal Mesh Lawsuit News: Bernstein Liebhard LLP Notes Release of New Order in Federal Ethicon Mesh Litigation Concerning Upcoming Bellwether Trial

Thousands of vaginal mesh lawsuits (http://www.transvaginalmeshlawsuitclaims.com/ ) filed over injuries allegedly caused by Ethicon, Inc.’s Gynecare pelvic mesh devices continue to move forward in a multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia. According to the Third Amended Docket Control Order issued on December 11, 2013, the Court has directed that case specific discovery for the litigation’s first bellwether trial is to be completed by December 31, 2013. The Order also stipulates, among other things, that a Pretrial Conference will be conducted on January 16, 2014, and that the parties submit jury instructions by January 31, 2014. The first bellwether trial in the Ethicon transvaginal mesh litigation is scheduled to begin on February 10, 2014, according to the Order. “We are representing hundreds of women who suffered serious transvaginal mesh complications, allegedly due to Ethicon’s Gynecare pelvic mesh products. We look forward to the start of this first federal trial in February, as it might provide insight into how juries will rule in other vaginal mesh lawsuits pending against Ethicon,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm continues to evaluate legal claims on behalf of women who suffered serious injuries, allegedly due to pelvic mesh products marketed by Ethicon, Inc. and other manufacturers. Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, is serving on the Plaintiffs’ Steering Committee in the federal Ethicon litigation underway in the Southern District of West Virginia.
