Ethicon Transvaginal Mesh Lawsuits Mount, as Bernstein Liebhard LLP Notes More than 16,000 Filings in Federal, State Litigations

Johnson & Johnson’s Ethicon, Inc. unit continues to be named a defendant in transvaginal mesh lawsuits ( ) filed on behalf of women who suffered mesh erosion, pain, infection, scarring, organ damage and other serious vaginal mesh complications, allegedly due to the company’s Gynecare pelvic mesh devices.

According to court documents, more than 12,000 such claims are pending in a multidistrict litigation underway in U.S. District Court, Southern District of West Virginia. (In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2327) An additional 4,551 Ethicon vaginal mesh lawsuits have been filed in a multicounty litigation now underway in New Jersey’s Atlantic County Superior Court.

“We are representing clients in each of these proceedings, and continue to hear from women on a regular basis who have allegedly suffered painful vaginal mesh complications following implantation of a Gynecare product. Vaginal Mesh Lawsuits
Court documents indicate that more than 35,000 vaginal mesh lawsuits have been filed in several multidistrict litigations underway in the Southern District of West Virginia. All of the claims pending in these proceedings similarly allege that transvaginal mesh devices marketed by Ethicon and other defendants were defectively designed and manufactured. They further allege that patients and doctors were not adequately warned of their serious risks.

In addition to his work on the federal Ethicon litigation, Bernstein Liebhard partner, Jeffrey S. Grand, is also serving on the Plaintiffs’ Steering Committees for three other federal vaginal mesh proceedings, including: American Medical Systems, Inc. (MDL No. 2325);Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187). He was also named Co-Liaison Counsel in a second litigation underway in Atlantic County Superior Court for lawsuits involving C.R. Bard products. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)

Mr. Grand was also a member of the Plaintiffs’ trial team for the first trial of an Ethicon vaginal mesh lawsuit in the New Jersey multicounty litigation. That trial ended in March with an $11 million award to a woman who suffered serious vaginal mesh complications due to the Gynecare Prolift device.
