DePuy Pinnacle lawsuit claims involving an all-metal version of the DePuy Pinnacle Hip Replacement System continue to move forward in the federal multidistrict litigation underway in U.S. District Court, Northern District of Texas. On July 16, 2013, the Court entered an Order regarding depositions that will be used in both state and federal DePuy hip replacement claims that resolves differences in the applicable rules and codes in various jurisdictions where those depositions may be needed. DePuy Pinnacle Hip Replacement Lawsuit
Court documents indicate that more than 4,400 claims are now pending in the federal litigation underway in Texas, all of which involve a metal-on-metal version of the Pinnacle hip that uses the Ultamet Liner. Among other things, Plaintiffs allege that they have suffered premature implant failure, metallosis and other serious complications due to the propensity of the device to shed dangerous amounts of metal ions into the tissue surrounding the implant, as well as the blood stream. They also question whether this version of the Pinnacle system should have been recalled, as it allegedly shares some of the same design flaws that prompted DePuy Orthopaedics to recall its ASR line of metal hip implants in 2010.
Metal-on-metal hip implants, like the DePuy Pinnacle hip replacement at the center of this litigation, have raised serious safety concerns in recent years. According to a New York Times report published on May 17th, DePuy Orthopaedics has decided to phase out sales of metal-on-metal hip implants, in part due to new U.S. Food & Drug Administration (FDA) regulation that would subject this class of devices to greater regulatory scrutiny. Among other things, the proposed FDA regulations would require the manufacturers of metal-on-metal hips currently on the market to conduct post-market safety studies in order to keep selling the products.*
