They further allege that the all-metal Pinnacle suffers from similar flaws that resulted in DePuy Othropaedics' worldwide recall of its ASR hip replacement line in August 2010, and question whether the Pinnacle should be recalled as well. The first trial in the federal Pinnacle hip litigation is scheduled to begin in September 2014.

The New York Times reported on May 17th that DePuy Orthopaedics had decided to phase out metal-on-metal hip implants, including the device named in Pinnacle hip lawsuits. In doing so, DePuy cited slowing sales, as well as recent actions by the U.S. Food & Drug Administration (FDA) that would subject all-metal hips to greater regulatory security.* On January 17th, the FDA proposed a new regulation that would require the manufacturers of metal-on-metal hips currently on the market to conduct post-market safety studies of those products in order to keep selling them.
