DePuy Pinnacle lawsuits (http://www.depuypinnacle-lawsuit.com/) involving a metal-on-metal version of the DePuy Pinnacle Hip Replacement System continue to move forward in the multidistrict litigation underway in U.S. District Court, Northern District of Texas, Bernstein Liebhard LLP reports. According to court documents, attorneys for plaintiffs have proposed a consolidated trial involving six Pinnacle hip lawsuits for the litigation’s first bellwether trial. According to a Memorandum submitted to the court on September 3, 2013, plaintiffs contend that a consolidated trial is “the most efficient use of time and resources.” (In re: DePuy Orthopaedics Inc. Pinnacle Hip Lawsuits
According to court documents, at least 4,880 DePuy Pinnacle lawsuits are pending in the Northern District of Texas. All of the claims involve a version of the Pinnacle hip implant that utilizes the Ultamet liner. Plaintiffs allege that the device’s metal-on-metal design allows for wear that can cause it to shed dangerous amounts of metal ions into surrounding tissue and the blood stream. They further allege that the all-metal Pinnacle suffers from similar flaws that resulted in DePuy Othropaedics' worldwide recall of its ASR hip replacement line in August 2010, and question whether the Pinnacle should be recalled as well. The first trial in the federal Pinnacle hip litigation is scheduled to begin in September 2014.
The New York Times reported on May 17th that DePuy Orthopaedics had decided to phase out metal-on-metal hip implants, including the device named in Pinnacle hip lawsuits. In doing so, DePuy cited slowing sales, as well as recent actions by the U.S. Food & Drug Administration (FDA) that would subject all-metal hips to greater regulatory security.* On January 17th, the FDA proposed a new regulation that would require the manufacturers of metal-on-metal hips currently on the market to conduct post-market safety studies of those products in order to keep selling them.
