DePuy Pinnacle Lawsuit News: Bernstein Liebhard LLP Notes New Order in Federal Pinnacle Litigation Requiring Production of Monitoring Reports from Federal Investigation

DePuy Pinnacle lawsuit claims involving a metal-on-metal version of the DePuy Pinnacle Hip Replacement System continue to move forward in the multidistrict litigation underway in Texas Federal Court, Bernstein Liebhard LLP reports. According to an Order dated May 15th, the Court has directed DePuy Orthopaedics to produce monitoring reports associated with a 2007 criminal investigation by the federal government into the company’s medical device marketing practices. Plaintiffs maintained in their December 2012 Motion to Compel that the reports will address allegations that DePuy had offered “consulting agreements” to physicians between 2002 and 2006 “to induce surgeons” to use its knee and hip products.
