DePuy Pinnacle lawsuit claims involving a metal-on-metal version of the DePuy Pinnacle Hip Replacement System continue to move forward in the multidistrict litigation underway in Texas Federal Court, Bernstein Liebhard LLP reports. According to an Order dated May 15th, the Court has directed DePuy Orthopaedics to produce monitoring reports associated with a 2007 criminal investigation by the federal government into the company’s medical device marketing practices. Plaintiffs maintained in their December 2012 Motion to Compel that the reports will address allegations that DePuy had offered “consulting agreements” to physicians between 2002 and 2006 “to induce surgeons” to use its knee and hip products. Court records indicate that more than 4,000 DePuy Pinnacle lawsuits are currently pending in the federal litigation underway in Texas. All of the claims allege the all-metal version of the hip that utilizes the Ultamet liner is vulnerable to wear and can shed dangerous amounts of metal debris, leading to premature implant failure, metallosis and other debilitating complications. The lawsuits further allege that the Pinnacle hip replacements suffer from many of the same design defects that prompted the 2010 DePuy ASR hip recall, and question whether a DePuy Pinnacle recall should have been issued as well.
While there has not been a DePuy Pinnacle recall for the metal-on-metal hip, DePuy Orthopaedics did announce last week that it would be ending sales of all-metal hips, including the Pinnacle. In doing so, the company cited decreased demand for such products, as well as the possibility of increased regulatory oversight of metal-on-metal hips, according to a May 17th report from The New York Times.* In January, the U.S. Food & Drug Administration (FDA) proposed new regulations for all-metal hips that would require the manufacturers of devices currently on the market to conduct post-market safety studies in order to keep selling them.**
