DePuy ASR Lawsuits Move Forward, as Bernstein Liebhard LLP Notes Release of New Pretrial Order in New Jersey DePuy ASR Recall Litigation
Date:8/7/2013

New York, New York (PRWEB) August 07, 2013

Lawsuits filed in the wake of the 2010 DePuy ASR recall (http://www.depuy-asr-hip-recall.com/) continue to move forward in a Multicounty Litigation now underway in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to a Pretrial Order issued on July 26th, the court has established deadlines for submission of proposed jury questionnaires, verdict forms and jury instructions for the litigation’s first bellwether trial. Among other things, the Order also stipulates that any motions for dismissal or summary judgment must be filed with the Court by September 17th. The Order sets a Pretrial Conference for October 8th, with the trial scheduled to get underway on October 21, 2013. (In Re DePuy ASR Hip Implants Litigation, BER-L-3971-11)

“We are representing hundreds of clients in DePuy ASR lawsuits. This trial, along with the bellwether trial scheduled to begin next month in the federal multidistrict litigation, are important steps forward in the litigation and could provide clues as to how juries might weigh evidence in similar cases,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm continues to offer free legal evaluations to anyone who suffered serious complications associated with the DePuy ASR recall.

DePuy ASR Lawsuits
According to the U.S. Food & Drug Administration, a worldwide recall was announced in August 2010 for DePuy ASR hip implants, after the metal-on-metal devices were found to be failing prematurely in an unexpectedly high number of recipients. Since then, Johnson & Johnson and its DePuy Orthopaedics unit have been named in more than 11,000 DePuy ASR lawsuits, all of which allege that toxic metal debris shed from the device caused plaintiffs to suffer metallosis, premature device failure and other serious complications that in some cases resulted in revision surgery. Bernstein Liebhard LLP is representing hundreds of DePuy ASR clients in a federal multidistrict litigation now underway in U.S. District Court, Northern District of Ohio. Court documents indicate the first bellwether trial in that proceeding will begin on September 9, 2013. (In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation – MDL 2197)

Earlier this year, two DePuy ASR trials concluded in California and Illinois state courts. In March, a Los Angeles Superior Court jury found that the ASR was defectively designed, and awarded more than $8 million to the Plaintiff in that case. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County). A month later, a jury hearing a case in Chicago found for DePuy and Johnson & Johnson. (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County)

Recipients of the DePuy ASR hip who suffered premature device failure, metallosis, or other serious complications may be entitled to compensation for medical bills, lost wages, pain and suffering, and other damages.
