DePuy ASR lawsuit claims filed in the wake of the August 2010 DePuy ASR hip replacement recall continue to move forward in a Multicounty Litigation now underway in New Jersey Superior Court, Bergen County, Bernstein Liebhard LLP reports. According to court documents, Superior Court Judge Brian R. Martinotti convened a Case Management Conference on July 11th, at which time a number of issues, including discovery and bellwether trials, were discussed. Among other things, the parties have been directed to submit a proposed pretrial order for the litigation’s first trial, which is scheduled to begin on October 21, 2013. DePuy ASR Recall
The DePuy ASR recall was announced in August 2010, due to the high failure rates associated with the implant.* Plaintiffs in DePuy ASR lawsuits allege the metal debris shed from the hip replacements can build to dangerous levels in the body, resulting in metallosis, premature device failure and other serious complications that may necessitate revision surgery. Court records indicate that more than 11,000 personal injury claims involving the ASR hip are now pending in U.S. Courts, with the majority filed in the federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio. On the state court level, two DePuy ASR lawsuits have already gone to trial. In March, a plaintiff was awarded more than $8 million after a Los Angeles Superior Court jury found that the hip implant was defectively designed. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, a jury in Chicago found for Johnson & Johnson in a second trial just one month later. (Strum v.
