Hundreds of DePuy ASR hip lawsuits (http://www.depuy-asr-hip-recall.com/) that are part of a consolidated docket in New Jersey Superior Court, Bergen County, continue to move forward, Bernstein Liebhard LLP reports. On August 21, 2013, the Court issued a Case Management Order that addressed a number of issues, including the progress of discovery and preparations for the DePuy ASR recall litigation’s first bellwether trial, which is scheduled to begin on October 21, 2013. Court records indicate that more than 650 DePuy ASR lawsuits are currently pending in the New Jersey proceeding. (In Re DePuy ASR Hip Implants Litigation, BER-L-3971-11)

DePuy ASR Recall
According to the U.S. Food & Drug Administration (FDA), the DePuy ASR recall was announced in August 2010 after data revealed that 13% of patients who received the metal-on-metal hip implants needed to have a second surgery to replace the device. Since then, court documents indicate that some 11,500 DePuy ASR lawsuits have been filed in courts around the country, all of which allege metal debris shed from the hip replacements can build to dangerous levels in the body, resulting in metallosis, premature device failure and other serious complications that may necessitate revision surgery.

In addition to the claims pending in the New Jersey proceeding, more than 7,800 DePuy ASR lawsuits involving similar allegations have been filed in a federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio. On the state court level, two DePuy ASR recall claims have already gone to trial. In March, a plaintiff was awarded more than $8 million after a Los Angeles Superior Court jury found that the hip implant was defectively designed. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, a jury in Chicago found for Johnson & Johnson in a second trial just one month later. (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County)
