New York, New York (PRWEB) September 06, 2013
The first of thousands of DePuy ASR hip lawsuit (http://www.depuy-asr-hip-recall.com/) claims pending in a federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio, will head to trial on September 9, 2013, Bernstein Liebhard LLP reports. Court documents indicate that nearly 8,000 DePuy ASR recall claims are pending in the federal proceeding. The case set for trial on Monday was filed on behalf of a Rochester, New York, woman who received her ASR hip implant on August. 24, 2009, and underwent revision surgery on January 17, 2011. Last month, her attorneys identified 95 potential witnesses that could be called to testify on her behalf. (McCracken v. DePuy Orthopaedics Inc., et al., No. 1:11-dp-20485)
“Our Firm is representing hundreds of clients in DePuy ASR lawsuits pending in this litigation, and we look forward to the start of this trial. Its outcome could provide valuable clues as to how juries might weigh evidence in similar DePuy ASR recall claims,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm continues to offer free legal evaluations to anyone who suffered serious complications allegedly associated with devices included in the DePuy ASR recall.
DePuy ASR Recall
According to the U.S. Food & Drug Administration, the DePuy ASR recall was announced after data from a United Kingdom hip registry indicated that the 5-year revision rates associated with the metal-on-metal hip implants were unacceptably high. Court records indicate that since the devices were pulled from the market, more than 11,000 DePuy ASR hip lawsuits have been filed in courts throughout the U.S. In addition to the federal litigation, DePuy ASR recall trials are also expected to get underway this fall in several state proceedings, including one that is to begin on October 15th in California Superior Court. (DePuy ASR HIP System Cases, No. CJC-10-004649; Calif. Super. Ct., San Francisco Cty.) A consolidated litigation underway in New Jersey Superior Court has scheduled its first DePuy ASR recall trial for October 21st. (In Re DePuy ASR Hip Implants Litigation, BER-L-3971-11)
Elsewhere, two DePuy ASR lawsuits have already gone to trial in state court. In March, a plaintiff was awarded more than $8 million after a Los Angeles Superior Court jury found that the hip implant was defectively designed. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, a jury in Chicago found for Johnson & Johnson in a second trial just one month later. (Strum v. DePuy, 2011-L-9352, Circuit Court
of Cook County)
Individuals affected by the DePuy ASR recall who allegedly experienced metallosis, premature device failure or other complications may be entitled to compensation for their medical bills, lost wages, pain and suffering, and other damages.
