DePuy ASR Hip Replacement Lawsuits Moving Along in California, Rottenstein Law Group LLP Reports

DePuy ASR hip lawsuits pending in San Francisco Superior Court are moving apace toward trial dates, reports the Rottenstein Law Group LLP, which maintains an ASR side effects and lawsuits website at http://www.rotlaw.com/depuy-asr-hip. A judge has set a July 26 deadline for motions for summary judgment in what will become the first DePuy ASR trial in coordinated proceedings in California, according to court documents.

“This is a typical step for any such case to go to trial,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP.

Plaintiff Robert Eugene Ottman’s lawsuit was selected as a bellwether, according to court documents in Ottman v. Johnson & Johnson Services, et al. (CGC-12-517391; California Superior Court.) Ottman alleges that DePuy failed to warn that his DePuy ASR metal-on-metal hip replacement, implanted in 2008, had a defective design that led to his enduring “painful and dangerous complications” that resulted in revision surgery and potentially lifelong problems.

DePuy recalled the ASR in 2010. The product has been under U.S. Food and Drug Administration scrutiny, primarily because of one dangerous alleged side effect called “metal poisoning,” or “metallosis.” According to the FDA*, cobalt and chromium particles could flake off into the implantee’s bloodstream when the device’s metal parts rub together. This could lead to potentially severe health problems.

There are more than a thousand lawsuits consolidated in federal court, according to court documents in In re: DePuy Orthopaedics Inc., ASR Hip Implant Products Liability Litigation (MDL-2197; U.S District Court for the Northern District of Ohio).
