DePuy ASR Hip Lawsuit Judge Upholds $8.3 Million Verdict in Nation’s First Trial Stemming from 2010 DePuy ASR Recall, Bernstein Liebhard LLP Reports

Bernstein Liebhard LLP notes that the California judge overseeing the nation’s first DePuy ASR lawsuit trial has rejected Johnson & Johnson’s motions for a new trial and a judgment notwithstanding the verdict. In March, the jury hearing the DePuy ASR recall lawsuit in Los Angeles Superior Court found the hip was defectively designed, and awarded more than $8.3 million to the Plaintiff. In a ruling handed down on May 24th, Judge J. Stephen Czuleger upheld the jury’s decision, finding the Plaintiff had provided enough evidence to show the recalled metal-on-metal hips were defectively designed. (Kransky v. Court records indicate that there are more than 10,000 DePuy ASR hip lawsuits currently pending throughout the U.S, most of which have been filed in a multidistrict litigation underway in U.S. District Court, Northern District of Ohio.
