Bernstein Liebhard LLP notes that the California judge overseeing the nation’s first DePuy ASR lawsuit trial has rejected Johnson & Johnson’s motions for a new trial and a judgment notwithstanding the verdict. In March, the jury hearing the DePuy ASR recall lawsuit in Los Angeles Superior Court found the hip was defectively designed, and awarded more than $8.3 million to the Plaintiff. In a ruling handed down on May 24th, Judge J. Stephen Czuleger upheld the jury’s decision, finding the Plaintiff had provided enough evidence to show the recalled metal-on-metal hips were defectively designed. (Kransky v. DePuy ASR Hip Lawsuits
Court records indicate that there are more than 10,000 DePuy ASR hip lawsuits currently pending throughout the U.S, most of which have been filed in a multidistrict litigation underway in U.S. District Court, Northern District of Ohio. Court documents indicate that during the recently-concluded trial in Los Angeles, evidence was introduced that indicated that Johnson & Johnson and its DePuy Orthopaedics unit knew that the ASR was defective years before the recall was announced. However, that information was not shared with the public or the medical community. According to a New York Times report published on April 16th, much of the same evidence was introduced in a second trial that concluded last month in Illinois state court. The DePuy ASR hip recall was announced in August 2010, after the metal-on-metal hip implants were found to be failing in 12-13% of recipients within just five years of implantation. Since then, the entire class of metal-on-metal hip implants has come under scrutiny, with the U.S. Food & Drug Administration (FDA) recently proposing new rules that would subject the devices to greater regulatory oversight.**
