The case, underway in Washington State Superior Court, was filed by the widow of a man who died several years after he suffered complications in a robot-assisted prostate removal, according to a report from Bloomberg News. The case underway in Washington is just one of 26 da Vinci surgical robot lawsuits filed against Intuitive Surgical that allege defects with the machine and/or inadequate doctor training, according to an April 19th filing with the U.S. Securities and Exchange Commission. According to Bloomberg News, emails disclosed ahead of the trial suggest the company’s salesmen lobbied hospitals to scale back doctor training. In one such communication, for example, a manager told a sales team not to “let proctoring or credentialing get in the way” of meeting goals on the number of robot surgeries.

Most recently, an expert testifying for the plaintiff told the jury that the patient could have lived five more years, with a better quality of life, had he not suffered serious da Vinci surgery complications during a prostate removal that lasted more than seven hours. Earlier, the man’s surgeon had testified that he was told by Intuitive Surgical that he would be ready to operate with the Da Vinci following a single day of training and two supervised operations. During his testimony, the doctor acknowledged that he now realizes he required additional training, Bloomberg.com said.

In addition to the da Vinci robot lawsuits pending in courts throughout the U.S., Intuitive Surgical is facing scrutiny on the regulatory front as well. In January, the U.S. Food & Drug Administration (FDA) launched a probe of the Da Vinci robot to determine if an increase in adverse events related to such procedures is a reflection of a real and growing problem. Among other things, the survey asked doctors to discuss their training on the machine, and to list any Da Vinci robot complications they may have observed.

Just last week, Intuitive issued an Urgent Medical Device Notification to hospitals regarding a “potential issue” involving “micro-cracks” on instruments called EndoWrist Monopolar Curved Scissors that are used with the robot. These cracks, which may not be visible to the user, could cause heat to leak and burn tissue. According to a report from The Wall Street Journal, one injury by an instrument later found to have micro-cracks has been reported to Intuitive Surgical.
