Da Vinci Surgical Robot Lawsuit News: Rottenstein Law Group LLP Comments on Intuitive Win in Negligent Training Trial

Da Vinci surgical robot maker Intuitive Surgical defeated negligent training claims in a trial in Washington State May 23, according to Bloomberg.* The Rottenstein Law Group LLP, which represents clients in surgical robot lawsuits, expresses disappointment in the ruling but encourages those looking to file da Vinci lawsuits to not read a single verdict as representative of all da Vinci lawsuits.

This case (Estate of Fred E. Taylor v. Intuitive Surgical Inc.; 09-2-03136-5, Superior Court, Port Orchard, Wash.) focused on the claims by the plaintiff that Intuitive did not adequately train the urologist who performed the prostate removal on Fred Taylor, whose 2012 death they blame on an allegedly defective surgery, according to Bloomberg. The Taylor family sought more than $8.4 million in damages. The jury decided the verdict after a day of deliberations with a 10-2 vote, the Bloomberg story said.

“This is but one da Vinci trial with a specific type of claim,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “There are several more whose verdicts could be decided in favor of the plaintiffs.”

Intuitive throughout the trial asserted that Taylor’s urologist performed the surgery on the obese Taylor, violating the company’s surgical guidelines, and so it is not at fault, the story said. Intuitive Surgical asserts that it is fully committed to superior training opportunities for surgeons and surgical teams in the use of its products, but notes that it does not participate in determining when a surgeon is adequately prepared to operate using the da Vinci Surgical System. According to a USA Today article, the da Vinci surgical robot was used in about 400,000 surgeries in 2012.**
