As robotic surgery lawsuit (http://www.davincisurgery-lawsuit.com) claims over injuries allegedly caused by the da Vinci Surgical system continue to be filed in courts around the country, Bernstein Liebhard LLP notes that a new study conducted by researchers at Johns Hopkins Medicine suggests that robotic surgery complications may be underreported to the U.S. Food & Drug Administration (FDA). The study found that even though over one million robotic surgeries have been performed since 2000, just 245 complications were reported during that time period to the FDA. The authors of the study assert that the number is “very low for a complex technology” that has been used so frequently, and expressed concerns that underreporting would make it difficult for doctors and patients to accurately evaluate the safety of robot-assisted surgery.*

Da Vinci Surgery Lawsuits
The da Vinci Surgical System was brought to market in 2000 by Intuitive Surgical, Inc., and is the only robotic surgery platform approved in the U.S. for use in soft tissue procedures. According to the study published in the Journal of Healthcare Quality, at least 71 of the 245 robotic surgery complications reported to the FDA since 2000 involved fatalities, most of which resulted from excessive bleeding. Gynecological procedures were most likely to be associated with deaths, followed by urological and cardiothoracic surgeries. Robot-assisted hysterectomies were associated with 43 percent of the injuries reported to the FDA.
Intuitive Surgical, Inc., the manufacturer of the da Vinci Surgical System, has been named in 33 robotic surgery lawsuits filed in various state and federal courts that allege use of the da Vinci robot caused patients to suffer serious, and in some cases fatal, injuries. Intuitive also disclosed that it had entered into tolling agreements in some of these cases, “in an effort to provide an orderly process for evaluating claims before they result in costly litigation.”**
