As da Vinci robot lawsuits (http://www.davincirobotlawsuithelp.com/) alleging injuries due to the da Vinci Surgical System continue to mount in courts around the country, Bernstein Liebhard LLP notes that the AARP recently published a report urging patients to proceed with caution when considering robotic surgery. Among other things, the report, which appears in the December/January issue of AARP Magazine, cites the potential for robotic surgery complications, including nerve damage and surgical burns, which may be associated with the da Vinci. And while the article acknowledges that robot-assisted procedures can offer patients faster recoveries and less blood loss compared to open surgeries, the report also points out that a number of studies have found that robotic surgery offers patients no added benefits over other minimally invasive methods. Several of these same studies have also found that robot-assisted surgery can cost a good deal more.*
“Some of the concerns raised by the AARP report echo allegations put forth in many da Vinci robot lawsuits. Da Vinci Robot Lawsuits
The publication of the AARP report comes at a time when robotic surgery is coming under increasing scrutiny. According to a Bloomberg.com report published in November, the U.S. Food & Drug Administration (FDA) has confirmed that robotic surgery complications related to the da Vinci Surgical System had more than doubled over the past year. For its part, Intuitive Surgical, Inc., the manufacturer of the device, told Bloomberg.com that the recent growth in adverse event reports is related to a corresponding increase in use of the da Vinci robot. In an emailed statement, a company spokesperson maintained that “total adverse event rates have remained low and in line with historical trends.” **
A second Bloomberg.com report published on December 30th found that many adverse events related to the da Vinci have gone unreported for years, while some – including several alleged in da Vinci robot lawsuits – have not been reported at all. Intuitive Surgical maintains that the issues uncovered by Bloomberg.com occurred because the company often doesn’t find out about an injury until years after it happened. The Bloomberg article also noted that a report of a robotic surgery complication doesn’t necessarily mean that the da Vinci robot caused an injury, only that the device was being used in an operation where the complication occurred.***
In a regulatory filing issued in the fall, Intuitive Surgical disclosed that it had been named in at least 50 da Vinci robot lawsuits pending in courts around the country. The company stated that many of these claims allege that patients sustained serious robotic surgery complications due to defects in the da Vinci Surgical System and/or failure on Intuitive’s part to provide adequate training resources to surgeons.****
