Da Vinci Robot Lawsuit News: Bernstein Liebhard LLP Comments on Release of FDA Warning Letter to Intuitive Surgical

Another correction letter cited by the FDA involved the use of the da Vinci robot in thyroidectomies, a procedure that has not been approved by the agency. Intuitive issued that correction after receiving 13 complaints about problems that occurred in da Vinci thyroidectomies.

On July 22, 2013, an Intuitive Surgical regulatory filing disclosed that the company had been named in 33 individual da Vinci lawsuits filed in various state and federal courts that allege use of the robot caused patients to suffer serious, and in some cases fatal, injuries. According to the company, these lawsuits claim that da Vinci complications resulted from purported defects in the da Vinci Surgical System and/or Intuitive’s failure to provide adequate training resources to the healthcare professionals who performed plaintiffs’ surgeries. Intuitive also disclosed that it had entered into tolling agreements in some of these cases, “in an effort to provide an orderly process for evaluating claims before they result in costly litigation.” **
