Charlotte Attorney Secures $1.4 Million Settlement for Cyclist Injured in Head-On Collision with Automobile

Herbert Auger, veteran personal injury attorney, obtains substantial cash settlement for client who suffered major injuries when struck by SUV

Charlotte, N.C. (Lexis Nexis) March 1, 2010 -- Highly regarded Charlotte attorneys Herbert W. The names of the parties and certain facts of the incident were made confidential as part of the mediated settlement.

The Augers' client, a middle age man, was cycling with a friend on a two-lane road when the driver of an SUV made a sudden left turn from the opposite lane of travel and directly into the cyclist lane of travel causing a head on collision. The client suffered major injuries, including: head injury with bleeding on the brain; compound fractures of the cervical spine with nerve root impingement, requiring surgery to fuse the discs; and injury to the right thumb requiring surgery to re-attach the ulnar ligament.

Herbert Auger, a respected auto accident and personal injury attorney, filed a claim against the driver of the vehicle's auto insurance carrier and the driver's excess or umbrella carrier. Auger ultimately negotiated a settlement at mediation of $1.4 million to compensate his client for his injuries. The first $300,000 of the settlement was paid by the driver's primary auto insurance carrier. The remaining $1.1 million was paid by the umbrella carrier.
