Changes to Georgia Workers’ Compensation Laws Set to Take Effect on July 1, 2013

The Georgia State Legislature recently enacted a law that will bring about changes to the state’s workers’ compensation system, and the attorneys at the firm would like to provide the public with a brief overview of those changes.

Specifically, the new law was signed on May 6, 2013 by the governor and it takes effect on July 1, 2013. Some of the tenets of the new law will be seen as a benefit for injured workers in the state while others may not be received in a positive manner. In terms of the potentially negative changes with respect to injured workers, anyone who is deemed to have suffered a ‘non-catastrophic’ injury will have his or her medical benefits limited to a period of 400 weeks.

However, there are also aspects of the new law that will likely be met with relief. For instance, the maximum amount of workers’ compensation benefits available for those who qualify for what is known as temporary total disability will increase to $525 per week, up from $500. The maximum weekly benefit for those who are classified as suffering from temporary partial disability will increase from $334 to $350 per week.

“The new Georgia workers’ compensation law provides what can be described as a mixed bag for injured workers. While their potential benefits will go up, they will face a shorter timeframe for which they can be treated by a medical doctor for non-catastrophic injuries. People in the state need to be aware of these changes to the law and seek the help of Georgia workers’ compensation lawyers if they are concerned about their situation,” said Jaret Spevak, a partner at Rechtman & Spevak.
