C8 Lawyers at Wright & Schulte LLC Investigating C8 Lawsuits For Individuals Allegedly Sickened by C8 Tainted Drinking Water in Ohio and West Virginia

Anyone living or working in one of six Ohio and West Virginia water districts prior to December 3, 2004, or their survivors, may be entitled to file a C8 lawsuit for personal injury or wrongful death if they or their loved one suffered from an illness that may be linked to C8 exposure, including:

  •     Testicular cancer
  •     Thyroid disease
  •     Inflammatory bowel disease (ulcerative colitis)
  •     Preeclampsia (high blood pressure during pregnancy)

DuPont C8 Lawsuit Timeline
April 8, 2013: More than two dozen C8 lawsuits alleging personal injury and wrongful death due to C8 pollution from the DuPont Washington Works Plant are consolidated in the U.S. District Court, Southern District of Ohio. The multidistrict litigation will serve as the venue for all pending and future C8 lawsuits filed against DuPont. (In Re: E.I. October 2012: The C8 Science Panel reports that it has established a probable link between C8 exposure and a number of disorders, including testicular and kidney cancers, pregnancy-induced hypertension (pre-eclampsia), thyroid disease, high cholesterol and inflammatory bowel disease. 2005: DuPont reaches a C8 class action lawsuit that will benefit 70,000 West Virginia and Ohio residents living and working near the Washington Works plant who were exposed to C8 tainted drinking water. Among other things, the agreement establishes the C8 Science Panel to explore “probable links” between C8 exposure and diseases. The settlement also stipulates that anyone exposed to C8 tainted drinking water for at least a year prior to December 3, 2004 will have the right to file an individual claim against DuPont if they developed any “probable link” disease identified by the Panel. Water districts specified by the DuPont C8 class action lawsuit settlement include:

  •     Little Hocking, Ohio
  •     City of Belpre, Ohio
  •     Tuppers Plains, Ohio
  •     Village of Pomeroy, Ohio
  •     Lubeck Public Service District, West Virginia
  •     Mason County Public Service District, West Virginia

March 2002: The water supply in Tupper Plains, Ohio, is found to be polluted with C8. Tupper Plains is located 15 miles downstream on the Ohio River from the Washington Works plant.

January 2002: Drinking water in Little Hocking, Ohio is found to be contaminated with C8.

August 2001: West Virginia residents file a C8 class action lawsuit against DuPont.

May 2000: C8 is phased out by 3M, which used the chemical to manufacture Scotchgard. The company does so following negotiations with the U.S. Environmental Protection Agency.

October 2000: DuPont resolves a C8 lawsuit filed by a West Virginia farmer who alleged his family was sickened and his cattle killed due to C8. Terms of the settlement, which were reached out of court, are not disclosed.

1984: DuPont’s own tests find the drinking water around the Washington Works plant is contaminated with C8. That year, the company also begins disposing of C8 polluted waste in the Dry Run Land fill near Lubeck, West Virginia. Tests conducted by DuPont have since confirmed that C8 is leaching from the landfill into Dry Run Creek at levels above DuPont’s internal limits.

May 1981: Five employees at the Washington Works plant who tested positive for C8 in their blood are found to have given birth to babies with eye-related birth defects.

March 1981: A 3M study links C8 exposure to eye defects in rats, prompting DuPont to bar female employees of child-bearing age from areas of the Washington Works plant where C8 is used.

1978: 3M reports that C8 has been detected in the blood of its workers. DuPont learns of this information, but keeps the information to itself.

1951: DuPont starts using Teflon at its Washington Works Plant.

1938: Teflon is discovered by Roy Plunkett, an employee of Kinetic Chemicals in New Jersey.

There is still time for individuals suffering from a C8 linked illness to file a personal injury lawsuit, so long as they lived or worked in one of the six West Virginia or Ohio water districts for at least a year prior to December 3, 2004, Family members of individuals who died as a result of one of these diseases may also file a wrongful death lawsuit on their behalf, so long as their loved one lived or worked in one of the water districts during the time period stipulated by the DuPont C8 class action lawsuit settlement.
