DuPont C8 Lawsuits
According to court filings, all of the C8 lawsuits pending in the federal litigation allege personal injury and/or death due to exposure to C8 contaminated drinking water. C8 is a chemical used to manufacture Teflon which was used at the DuPont facility starting in the 1950s. Plaintiffs in C8 lawsuits allege DuPont had information in its possession as early as the 1980s that indicated exposure to C8-tainted drinking water could lead to serious adverse health consequences. They further claim that the company knew for several decades that discharge of C8 into the Ohio River from the Washington Works facility had polluted surrounding water supplies, and that this pollution could have been substantially reduced by use of a carbon absorption treatment system, court filing show.
In 2005, DuPont reached a C8 class action settlement affecting over 70,000 people living in six affected water districts in Ohio and West Virginia where dangerous levels of C8 pollution had been detected in drinking water. Among other things, the DuPont C8 class action settlement required that the company fund a C8 Science Panel which would investigate potential links between C8 exposure and disease. The settlement also stipulated that individuals who lived and worked in the impacted water districts would maintain their right to sue DuPont for personal injury if they suffered from any diseases or disorders the Panel ultimately determined were linked to C8 exposure. In October 2012, the C8 Science Panel announced it had found probable links between the chemical and a number of disorders, including testicular and kidney cancers, pregnancy-induced hypertension (pre-eclampsia), thyroid disease, high cholesterol and inflammatory bowel disease. Individuals who lived or worked in one of the water districts stipulated by the C8 lawsuit settlement for at least one year prior to December 3, 2004 are now eligible to file a personal injury lawsuit against DuPont. Survivors of individuals who died as a result of a probable linked illness may file a wrongful death suit against DuPont, so long as their loved one met all eligibility requirements set forth in the DuPont C8 class action lawsuit settlement.
