The C8 lawsuits pending in the federal multidistrict litigation were filed in accordance with the terms of the 2005 DuPont C8 class action settlement, which was struck on behalf of over 70,000 people living in the six affected water districts in Ohio and West Virginia. Among other things, the C8 lawsuit settlement required DuPont to establish the C8 Science Panel to explore “probable links” between C8 exposure and diseases. The settlement also stipulated that anyone who was exposed to C8-tainted drinking water for at least a year and developed a “probable link” disease would maintain their right to file an individual C8 lawsuit against DuPont. In October 2012, the C8 Science Panel concluded that there is a probable link between the chemical and a number of disorders, including testicular and kidney cancers, pregnancy-induced hypertension (pre-eclampsia), thyroid disease, high cholesterol and inflammatory bowel disease. Court documents indicate that the first individual C8 lawsuits were filed shortly thereafter, and on April 8th, the U.S. Judicial Panel on Multidistrict Litigation, ordered those and all future federal cases transferred to the Southern District of Ohio for coordinated pretrial proceedings. According to the C8 lawsuits filed in the Southern District of Ohio, C8 is a chemical in Teflon that was used for decades as the DuPont Washington Works plant. Plaintiffs allege DuPont had information in its possession as early as the 1980s that indicated exposure to C8-tainted drinking water could lead to various adverse health consequences in exposed workers. Lawsuits also claim that the company knew for several decades that discharge of C8 into the Ohio River from the Washington Works facility had polluted surrounding water supplies, and that this pollution could have been substantially reduced by use of a carbon absorption treatment system.
