C8 Lawsuit Lawyers at Wright & Schulte LLC Report on Growing Litigation Over Exposure to C8 Tainted Drinking Water from DuPont’s Washington Works Plant

The C8 lawsuit lawyers at Wright & Schulte LLC report that at least 44 C8 lawsuits have been filed in the U.S. District Court, Southern District of Ohio, all of which allege illness and wrongful death due to exposure to C8 tainted drinking water associated with the DuPont Washington Works plant in Parkersburg, West Virginia. That represents a significant increase from the 26 DuPont C8 lawsuits that were originally transferred to the Southern District of Ohio when the multidistrict litigation was first established in April. According to lawsuits pending in the Ohio multidistrict litigation, C8 is a chemical used in the manufacture of Teflon, and was discharged from the Washington Works plant for decades. In 2005, DuPont reached a C8 class action settlement affecting over 70,000 people living in in parts of Ohio and West Virginia where dangerous levels of C8 pollution had been detected in drinking water. Among other things, the DuPont C8 class action settlement required that the company fund a C8 Science Panel which would investigate potential links between C8 exposure and disease. In October 2012, the C8 Science Panel announced it had found probable links between the chemical and a number of disorders, including testicular and kidney cancers, pregnancy-induced hypertension (pre-eclampsia), thyroid disease, high cholesterol and inflammatory bowel disease.

The C8 lawsuit settlement also held that anyone who lived and worked in the impacted water districts during the timeframe stipulated by the agreement would maintain their right to sue DuPont for personal injury if they suffered from any diseases or disorders the Panel ultimately determined were linked to C8 exposure. The six affected water districts include:

  •     Little Hocking, Ohio
  •     Belpre, Ohio
  •     Village of Pomeroy, Ohio
  •     Tuppers Plains, Ohio
  •     Lubeck Public Service District, West Virginia
  •     Mason County Public Service District, West Virginia

All of the C8 lawsuits pending in the Ohio litigation have been filed in accordance with the terms of the C8 class action lawsuit settlement.
