Block O'Toole & Murphy, LLP Personal Injury Trial Lawyers Take $2,270,000 Verdict In Brooklyn Motor Vehicle Accident Case

On July 18, 2013, Block O'Toole & Murphy, LLP personal injury lawyers Scott Occhiogrosso and Frederick Aranki procured a $2,270,000 jury verdict in the case of Rosemary McKnight v. New York City Transit Authority and Jimmie Cotton, which proceeded under Index Number 23705/10 in the Supreme Court of the State of New York, Kings County. The verdict followed a 14 day trial, during which the nature and extent of Ms. McKnight's injuries were vigorously disputed.

According to the deposition and trial testimony, the matter stemmed from a June 2, 2010 collision between a New York City Transit Authority bus, on which the Plaintiff was a passenger, and a tanker truck. The collision occurred when the bus struck the truck in the rear.

During the trial, the defense contested the Plaintiff's alleged injuries, which consisted of neck injuries that were ultimately treated with a cervical spine surgery involving a fusion of the C4 through C7 vertebrae, and an exacerbation of prior lower back injury for which the Plaintiff had undergone a lumbar spine surgery nearly 4 years before this accident. The defense argued at trial that Plaintiff's injuries were not serious enough to deserve any monetary compensation at all, and pointed to the fact that the Plaintiff had been deemed physically disabled from employment before this accident occurred due to her prior injuries. Plaintiff alleged that had this incident not occurred, she would have been able to re-enter the workforce, and that this collision worsened her pre-existing injuries and significantly affected her daily life.
