Biomet Hip Lawsuits Move Forward, as Federal Court Issues New Order Pertaining to Non-Revision Biomet Hip Replacement Claims, Bernstein Liebhard LLP Reports

Among other things, the complaints point out that the Biomet M2a Magnum hip was permitted to come to market via the U.S. Food & Drug Administration’s (FDA) 510 (k) clearance program, which does not require that a device be subjected to human clinical trials.

According to a safety communication issued by the FDA last January, metal-on-metal hip implants may be more likely to fail within several years of surgery than those made from other materials. Patients implanted with these types of devices have been advised to seek medical attention if they experience any symptoms that could indicate their artificial hip may be failing prematurely. The FDA has also proposed a new regulation that would no longer allow 510(k) approvals for all-metal hips. The new rules would also require the manufacturers of metal-on-metal hip implants already on the market to conduct post-safety studies of their products if they want to continue selling them.
