Biomet Hip Lawsuits Move Forward, as Federal Court Issues New Order Pertaining to Non-Revision Biomet Hip Replacement Claims, Bernstein Liebhard LLP Reports

Biomet hip lawsuits (http://www.consumerinjurylawyers.com/biomet-magnum-hip-replacement) alleging injuries due to the metal-on-metal design of the Biomet M2a Magnum Hip Replacement System continue to move forward in U.S. District Court, Northern District of Indiana, Bernstein Liebhard LLP reports. According to an Order issued on December 11, 2013, the Court is preparing to establish a Non-Revision Track for all claims filed on behalf of plaintiffs who have not undergone revision surgery of their Biomet hip replacement. The parties have been directed to submit an agreed-upon list of cases to be included on the Non-Revision Track no later than January 22, 2014. The Order states that the Court will then stay all proceedings in the non-revision cases until further notice. According to court documents, nearly 900 Biomet hip lawsuits are now pending in the proceeding underway in Indiana. These lawsuits allege that microscopic metal particles shed from the M2a Magnum hip can cause debilitating complications, including metallosis, chronic pain, and loss of mobility. In many of these claims, plaintiffs allege that they were forced to undergo revision surgery to remove and replace their Biomet hip replacement due to these types of injuries. Among other things, the complaints point out that the Biomet M2a Magnum hip was permitted to come to market via the U.S. Food & Drug Administration’s (FDA) 510 (k) clearance program, which does not require that a device be subjected to human clinical trials.

According to a safety communication issued by the FDA last January, metal-on-metal hip implants may be more likely to fail within several years of surgery than those made from other materials. Patients implanted with these types of devices have been advised to seek medical attention if they experience any symptoms that could indicate their artificial hip may be failing prematurely. The FDA has also proposed a new regulation that would no longer allow 510(k) approvals for all-metal hips. The new rules would also require the manufacturers of metal-on-metal hip implants already on the market to conduct post-safety studies of their products if they want to continue selling them.
