Bernstein Liebhard LLP Launches New Transvaginal Mesh Lawsuit Website as Claims Continue to Mount in U.S. Litigations

thicon, Inc. (MDL No. 2327). Jeffrey S. Grand, a partner at Bernstein Liebhard LLP, is actively serving on the Plaintiffs’ Steering Committees for the above four litigations.

Mr. Grand is also serving as Co-Liaison Counsel in two consolidated proceedings established in New Jersey’s Atlantic County Superior Court, where claims involving products from C.R. Bard and Ethicon have been filed. In the C.R. Bard proceeding, court documents issued in December show that over 900 cases have been filed, while nearly 4,600 lawsuits are now pending in the Ethicon litigation. Mr. Grand served on the trial team for the Ethicon proceeding’s first trial, which completed in March 2013 with an $11 million damage award to the Plaintiff, who received a Gynecare pelvic mesh implant. The number of transvaginal mesh lawsuits has steadily grown over the past five years. In 2008, The U.S. Food and Drug Administration (FDA) issued its first public health alert regarding this class of devices after receiving numerous adverse event reports that detailed such side effects as organ damage, chronic infection and shrinkage. At the time, the potential for these complications to occur was classified as “rare” by the federal agency; a stance it upgraded in 2011 to “not rare” after the number of FDA-filed complaint reports increased steadily over a three-year period.*
