Bernstein Liebhard LLP Launches New Transvaginal Mesh Lawsuit Website as Claims Continue to Mount in U.S. Litigations

A new transvaginal mesh lawsuit ( website has been launched by the attorneys at Bernstein Liebhard LLP, who are actively filing claims on behalf of women who may have sustained pelvic mesh injuries.

The Firm’s new site will include vital information regarding the process of filing a case alleging mesh erosion, pain, vaginal scarring, infection, organ perforation and other serious complications, as well as updates in the fast-growing nationwide litigation of vaginal mesh lawsuits. According to court documents, at least 40,000 claims involving this class of devices, which are used in the treatment of pelvic organ prolapse (POP) and stress urinary incontinence (SUI), are currently pending in federal and state courts throughout the U.S. These lawsuits involve products marketed by such manufacturers as Ethicon Inc., American Medical Systems, Inc., C.R. Bard, Inc., and Boston Scientific Corp.

Transvaginal Mesh Lawsuits
The majority of transvaginal mesh lawsuits filed in the U.S. are now pending in separate federal multidistrict litigations established in the U.S. District Court, Southern District of West Virginia. These proceedings include: American Medical Systems (MDL No. 2325), Boston Scientific Corp., (MDL No. 2326); C.R. Bard, Inc., (MDL No. 2187), and Ethicon, Inc. (MDL No. 2327). Jeffrey S. Mr. Grand is also serving as Co-Liaison Counsel in two consolidated proceedings established in New Jersey’s Atlantic County Superior Court, where claims involving products from C.R. Bard and Ethicon have been filed. In the C.R. Bard proceeding, court documents issued in December show that over 900 cases have been filed, while nearly 4,600 lawsuits are now pending in the Ethicon litigation. Mr. Grand served on the trial team for the Ethicon proceeding’s first trial, which completed in March 2013 with an $11 million damage award to the Plaintiff, who received a Gynecare pelvic mesh implant. The number of transvaginal mesh lawsuits has steadily grown over the past five years. In 2008, The U.S. Food and Drug Administration (FDA) issued its first public health alert regarding this class of devices after receiving numerous adverse event reports that detailed such side effects as organ damage, chronic infection and shrinkage. At the time, the potential for these complications to occur was classified as “rare” by the federal agency; a stance it upgraded in 2011 to “not rare” after the number of FDA-filed complaint reports increased steadily over a three-year period.*
