Mirena IUD Lawsuits

The Mirena IUD is a t-shaped intrauterine device implanted into a woman’s uterus to prevent pregnancy for up to five years. Approved by the U.S. Food and Drug Administration (FDA) in 2000 as a method of contraception, Mirena’s approved uses were later expanded to include heavy menstrual bleeding in women who wish to use an IUD as their method of birth control. In 2009, the FDA sent a warning letter to Bayer after determining that the company’s promotion of Mirena overstated its efficacy and minimized its risks.*

A rising number of Mirena IUD lawsuits have already been brought by women who claim to have experienced the serious side effects associated with Mirena. Right now, at least 16 claims are pending in New Jersey Superior Court. Bayer Healthcare Pharmaceuticals filed a motion last August to consolidate the Mirena IUD lawsuits in New Jersey before a judge in Middlesex County, which was later denied.**

On January 16, 2013, plaintiffs filed a petition with the U.S. Judicial Panel for Multidistrict Litigation (JPML) to transfer all pending and future federally-filed Mirena lawsuits to the U.S. District Court, Northern District of Ohio for pretrial proceedings. The petition stated that eight lawsuits, which are pending in federal court, claim the Mirena IUD can migrate within a woman’s body once inserted and is designed defectively. The petition also asserted that hundreds of similar claims are likely to be filed over the Mirena IUD in the future.***
