Baron and Budd Announces Second Transvaginal Mesh Lawsuit Settlement for Bard

Minutes before the trial proceedings for the second federal transvaginal mesh lawsuit for C.R. Bard’s Avaulta were scheduled to begin, news broke that Bard had settled with the plaintiff for an undisclosed amount. Considered a bellwether lawsuit that could help determine the future of subsequent transvaginal mesh claims, the settlement may portend that Bard and even other manufacturers of transvaginal mesh are more willing to settle cases instead of proceeding to public trial. Transvaginal mesh is a medical device that is manufactured and distributed by numerous pharmaceutical companies. Mesh device names and companies include C.R. Bard’s Avaulta, Johnson & Johnson subsidiary Ethicon’s Gynecare, Boston Scientific Scimmed’s Pinnacle pelvic mesh and American Medical System’s products including AMG BioArc, MiniArc, Monarc and Straight-In Mesh. While Bard has just settled its second federal transvaginal mesh lawsuit, many transvaginal mesh device manufacturers are facing similar transvaginal mesh lawsuits for injuries including bladder, bowel and even blood vessel perforation and the need for costly and sometimes even multiple revision surgeries. This settlement was decided just days after another jury found Bard liable in its first federal transvaginal mesh lawsuit, thereby awarding the plaintiff $2 million for her injuries. (In re C.R.
