As Tylenol Lawsuits Mount, Bernstein Liebhard LLP Comments on New Analysis Questioning Labeling Standards for Over-The-Counter Acetaminophen Products

As Tylenol lawsuits (http://www.tylenollawsuitclaims.com/) continue to mount in federal court, Bernstein Liebhard LLP notes the publication of a new analysis by Consumer Reports that raises questions about the labeling standards for over-the-counter acetaminophen products. Among other things, Consumer Reports found that because federal health regulators seem to be more focused on prescription painkillers, labeling for over-the-counter medications containing acetaminophen is extremely inconsistent. For example, while some manufacturers set maximum daily dosage at 1,000 mg per day, labeling for other products suggests that up to four times as much can be taken safely. *

“Scores of Tylenol lawsuits are currently pending in U.S. courts that allege the acetaminophen contained in these products caused patients to suffer serious liver injuries. Tylenol Liver Damage Allegations
Court documents indicate that at least 150 Tylenol lawsuits involving liver damage allegations have been filed in a federal multidistrict litigation underway in U.S. District Court, Eastern District of Pennsylvania. Among other things, the claims allege that individuals who used these medication suffered severe liver damage resulting in hospitalization, liver transplantation, or death, even when the products were used in accordance with label directions. The Philadelphia Inquirer recently reported that 78,000 people require emergency room care every year due to toxic reactions to acetaminophen. Such injuries also result in about 33,000 hospitalizations every year.** In 2011, the U.S. Food & Drug Administration (FDA) announced that it would limit the amount of acetaminophen in prescription medications to 325 mg per tablet.

The FDA has not imposed similar limits on the amount of acetaminophen in over-the-counter products. In August 2013, Bloomberg.com reported that over-the-counter Extra Strength Tylenol caplets each contain 500 mg of acetaminophen, well over the new limits for prescription medications set by the FDA. That same month, McNeil Consumer Healthcare announced that it would add new, more prominent warnings regarding the risk of liver damage to the labels of Tylenol-brand medication.***
